These Terms of Service ("Terms") govern your use of the gartli web application and related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
gartli is a tool for planning and managing gardens. We may update, change, or discontinue features at any time without notice.
2. Accounts
- You must sign in via a supported authentication provider (e.g. Google).
- You are responsible for activity on your account and for keeping it secure.
- You must be at least 16 years old to use the Service.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or infringing purpose.
- Attempt to gain unauthorised access to the Service, other accounts, or systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, scrape, or use automated means to access the Service except as permitted in writing.
4. Your content
You retain ownership of the content you create in the Service ("Your Content"). You grant us a limited licence to host, store, and process Your Content solely to provide the Service to you. You are responsible for the legality of Your Content.
5. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
6. Fees
The Service may be offered free of charge or with paid features. If paid features are introduced, terms of payment will be presented before purchase.
7. Termination
You may stop using the Service at any time and request deletion of your account by contacting info@gartli.com. We may suspend or terminate access to the Service if you breach these Terms or to protect the Service.
8. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising from or in connection with the Service. Our total aggregate liability for direct damages is limited to the amount you paid us for the Service in the twelve months preceding the event giving rise to liability, or, if no payment was made, CHF 50.
10. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your use of the Service in violation of these Terms or applicable law.
11. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced in the application or by email. Continued use of the Service after changes constitutes acceptance.
12. Governing law and venue
These Terms are governed by the laws of Switzerland, excluding its conflict of laws rules. The exclusive place of jurisdiction is Zurich, Switzerland, subject to any mandatory consumer protection laws of your place of residence.
